Big Run Council updates animal ordinance

BIG RUN — Big Run Borough Council modified its ordinance regarding the types of animals that are permitted in the borough.

Ordinance No. 221 was passed at Monday's meeting — an ordinance that repealed Ordinance No. 15, said Nick Lantz, Big Run Borough Council president.

Ordinance No. 221 reads, "An animal is any living creature except human beings, including dogs, cats, pigeons, birds, fish, gerbils, guinea pigs, rabbits, horses, stallions, mares, cows, bulls, steers, calves, hogs, swine, sheep, deer, turkeys, goats, chickens, ducks, geese, fowl, reptiles, ferrets, mice, rats or snakes."

The ordinance states that no owner should permit an animal to run at large within the borough of Big Run.

"At large" is defined in the ordinance as "An animal is at large when it is not confined to the premises of the owner by some physical means of sufficient height, strength, length and manner of construction to preclude the animal from leaving the premises of the owner. Any animal being contained by a fence that, because of the fence's lack of height or general disrepair, cannot properly restrict the animal, should be considered at large."

Lantz said the ordinance also contains a list of prohibited animals in the borough: horses, stallions, mares, cows, bulls, steers, calves, hogs, swine, sheep, deer, turkeys, goats, chickens, ducks, geese, fowl, reptiles, ferrets, mice, rats or snakes.

The penalties that were described are: "Any owner who violates or fails to comply with any provision of this ordinance shall be guilty of a summary offense and shall be subject to a fine up to $1,000 and/or imprisonment up to 30 days.

"Each day that the violation continues shall be a separate offense, and penalties shall be cumulative," the ordinance read.

In other business:
• Council approved Halloween and trick-or-treating to be held from 6 to 8 p.m. Wednesday, Oct. 31.

Joe Buterbaugh, Big Run mayor, said trick-or-treaters will only be permitted to go to houses that have their porch lights on.
